Terms of Use

These Terms of Use ("Terms") are an agreement between you and the maker of Pennen. They explain the rules for using Pennen, a private, handwritten journal app for iPad (the "App"). Please read them — by downloading or using the App, you agree to them.

Pennen is operated by Ishaan Rawat, a sole proprietor established in India ("we", "us", "our"). You can reach us any time at ishaan@ishaanrawat.com. How we handle the limited information involved is described in our Privacy Policy, which forms part of these Terms.

1. Agreement to these Terms

By downloading, installing, or using Pennen, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App. If you are using Pennen on behalf of someone else, you confirm you are authorized to accept these Terms for them.

2. The App and your license

Pennen is licensed, not sold, to you. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your own personal, non-commercial journaling, in accordance with these Terms and the App Store rules.

Your license is also governed by the Apple Standard Licensed Application End User License Agreement (the "Apple EULA"), available here. Where these Terms and the Apple EULA both apply, they are intended to work together; if there is a direct conflict about your license to use the App, the Apple EULA governs that point. You acknowledge that Apple is not a party to these Terms and is not responsible for the App, and that Apple and its subsidiaries are third-party beneficiaries of these Terms and the Apple EULA and may enforce them.

3. Eligibility

Pennen is a general-audience app intended for adults and is not directed to children. You must be at least the minimum age required in your country (16 in the EEA/UK unless a lower age is permitted, 13 in the United States) and able to form a binding contract to use the App, consistent with the App Store age rating.

4. Your content

Everything you write in Pennen — your handwriting, drawings, and pages — is yours. We do not claim any ownership of it, and we do not access, read, monetize, or use it to train anything. Your pages are stored on your device and, if you are signed in to iCloud, synced privately through your own iCloud account; we never receive them. You are responsible for your content and for keeping your own backups (for example, by staying signed in to iCloud). For details, see the Privacy Policy.

Pennen offers paid plans that unlock the App, sold as in-app purchases through the Apple App Store and billed to your Apple Account:

The current price of each plan is shown in the App and on the App Store before you buy, in your local currency, and may vary by region and over time. Payment is charged to your Apple Account at confirmation of purchase. There is no free trial.

If you already own a plan — for example after reinstalling or on another device — you can tap Restore on the subscribe screen (or in the App's Settings) to restore it at no additional charge.

7. Renewal, cancellation & refunds

Auto-renewal. An auto-renewable subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.

Cancellation. You can manage or cancel a subscription any time in Settings › your name › Subscriptions on your device, or via the App Store. Cancelling stops future renewals; you keep access until the end of the period you've already paid for. Deleting the App does not cancel a subscription. The Lifetime purchase is one-time and has nothing to renew or cancel.

Refunds. Purchases are processed by Apple, so all billing and refund requests are handled by Apple under the App Store terms. You can request a refund at reportaproblem.apple.com. Except where required by law, payments are otherwise non-refundable, and we do not control Apple's refund decisions.

8. Availability & changes

We work to keep Pennen running well, but we don't promise it will always be available, uninterrupted, or error-free. Pennen requires an iPad running iPadOS 26 or later and relies on Apple's iCloud and CloudKit for sync. We may update, change, or discontinue features of the App over time. We are not responsible for issues caused by Apple's services, your device, your network, or factors outside our reasonable control.

9. Disclaimers

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, be uninterrupted or error-free, or that any data will never be lost. Pennen is a journaling tool, not a backup service or a substitute for professional advice.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the extent we are found liable despite the above, our total liability for all claims relating to the App will not exceed the greater of the amount you paid for the App in the 12 months before the claim, or USD 25. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing in these Terms limits any rights you have that cannot be limited by law.

11. Termination

These Terms apply while you use the App. You may stop using Pennen at any time by deleting it. We may suspend or end your license if you materially breach these Terms or the Apple EULA, or where required by law. Provisions that by their nature should survive — such as content ownership, disclaimers, limitation of liability, and governing law — survive termination.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules, and the courts of Jaipur, Rajasthan, India will have jurisdiction, except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings, or require the application of their law, in which case those apply. Your license to use the App also remains subject to the Apple EULA and its terms.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, provide notice in the App. Your continued use of Pennen after an update means you accept the revised Terms; if you don't agree, please stop using the App.
